Q. Claimant reports on 6/24/19 she was breeding a cow and while holding the cow down with her left arm, felt pain. She alleges dislocation with hobby: competition with shotgun (done on weekly basis). The claimant is a Texas intern with a residence in Colorado. She will return to Colorado in August to continue her education and continue to work for same employer (hired 6/01/19). However, she does not have an address in Colorado yet. Her permanent address is in Wyoming. What is the appropriate jurisdiction with this information?

A. If this happened, and if it happened in Texas, then it is a Texas claim. It may be some other state’s claim too, but it is definitely a Texas claim.

Q. Have a claim where claimant reached stat MMI.  I assessed a rating and requested a DD. In the interim, the treating doctor issued a DWC-69 with MMI and a rating.  I disagree with it.  Do I refile for a DD exam or do I file something else?  I know I need to file something because I disagree with the DWC-69. 

A. You must file a DWC-45 requesting a BRC to dispute the treating doctor’s certification. The request for DDR will not do because that was done before the treating doctor’s certification.
