DWC Posts Informal Draft Amendments to SIF Reimbursement Rule
The Division of Workers’ Compensation has prepared informal draft amendments to Rule 116.11, Request for Reimbursement from the Subsequent Injury Fund, to require an insurance carrier to use DWC-prescribed forms (DWC Form-095 through DWC Form-098) to submit SIF reimbursement requests to DWC electronically.
DWC currently allows insurance carriers to submit SIF reimbursement requests electronically, but DWC still receives some paper requests by mail. In addition, DWC states that SIF requests that are not submitted on the recommended DWC forms—DWC Form-095 through DWC Form-098—often do not provide all the information needed to process these requests efficiently. The agency is concerned that incomplete requests require additional correspondence with the requester to get the missing information, which may cause delays in processing the requests.
Parties wishing to comment on the informal draft amendments may email their comments to RuleComments@tdi.texas.gov. The Division must receive written comments to the informal draft amendments by 5 p.m., Central time, on Friday, October 23, 2020. Parties may also mail or deliver their comments to:
