Q. Is it the 10th of every month that SIBs payments should be issued? When would they be considered late?
A. It depends upon whether you are dealing with the first quarter or a subsequent quarter. Then it depends upon whether you are dealing with the first month of the quarter or a subsequent (2nd or 3rd month) of the quarter. See Rule 130.107. Basically, if you pay the first month on or before day 7 of the quarter, the second month on or before day 37 of the quarter and the third month on or before day 67 of the quarter, you will be good. To do this, you must always know when the quarter started. Then count forward.
Q. Received a mileage request from a claimant recently. Some of the dates of the request go back as far as 2010. How far back can their requests go to be reimbursable under the WC claim file?
A. Per Rule 134.110(b), the injured employee shall submit the request for reimbursement to the insurance carrier within one year of the date the injured employee incurred the expenses.
