DWC Adopts Eight New Rules and Five New Forms

Texas DWC Commissioner Ryan Brannan has adopted eight new rules and has repealed two rules that are designed to align the agency’s rules with recent statutory requirements found in HB 2112.

The agency amended 28 Texas Administrative Code (TAC) §§ 110.105, 112.101, 112.102, 112.201, 112.202, 130.101, 130.102, and 136.1, and repealed 28 TAC §130.10 and §136.2. House Bill 2112 became effective on June 9, 2017.

The adoptions will be published in the April 6, 2018, issue of the Texas Register and available here once published. A courtesy copy of the adopted rules will also be available on the division website.

The division is posting finalized versions of several forms to its website simultaneously with the adoption of the new rules. Those forms include the DWC-81, DWC-82, DWC-83, DWC-84, and DWC-85. These forms are joint agreement forms that relate to the employment status of contractors, motor carriers and owner operators, as well as building and construction workers. In addition, the Division is removing from the DWC website the following forms: DWC Form-065 (which relates to the registry of private providers of vocational rehabilitation services) and DWC Form-020 (which deals with notice, cancellation, and nonrenewal of workers’ compensation coverage).
