DWC Posts Informal Rules to Implement TIBs Rate Change

The Division of Workers’ Compensation is accepting comment on an informal rule posting of amended 28 TAC §129.3 and §129.11 regarding income benefits–temporary income benefits. The informal rules were posted on June 8, 2015. The Division’s informal rule memo describes the nature and time frame related to the rule-making effort.

The comment period on the informal rule posting closes Thursday, June 25, 2015 at 5 p.m. Central Standard Time.

The purpose of the informal rule is to update Rule 129.3 and Rule 129.11 in order to implement Senate Bill 901, 84th Legislature, Regular Session (2015), which was signed into law by Governor Abbott on May 21, 2015. Senate Bill 901 changes the hourly wage used for computing the low wage earner TIBs described in Labor Code §408.103(a) from $8.50 to $10 an hour.
