Employee Benefit Rates Set to Increase October 1st

The Division of Workers’ Compensation has announced increases in the maximum and minimum benefit rates for injuries occurring October 1, 2021. The maximum TIBs rate will climb to $1,058, a 5.1% increase over the 2020-21 TIBs maximum rate.

The maximum rates for lifetime income benefits and death benefits are also set to rise to $1,058, although benefits for LIBs are subject to an annual 3% cost of living increase.

The maximum income benefit rate for impairment income benefits will increase from $705 to $741 while the maximum cap on weekly supplemental income benefits, which is used to calculate the monthly SIBs benefit payment will increase to $741 as well.

The minimum benefit rates for TIBs, IIBs, and LIBs will increase to $159.

The Division has published a table providing the maximum and minimum weekly benefits established in the Texas Workers’ Compensation Act applicable to dates of injuries on or after January 1, 1991. The maximum TIBs rate in January 1991 was $428. The new TIBs maximum rate represents a 250% increase over that first rate.

The maximum and minimum benefit rates in effect on the date of injury control for individual claims and remain fixed for the life of those claims.
