Q. I received an approved DWC-24 agreement. What is the deadline by which I’m required to pay benefits owed pursuant to that agreement?
A. You have five (5) days from the date the approved agreement was received by Carrier or anyone on behalf of the Carrier, unless the parties agreed to a different date on the DWC-24 itself. Immediately above the signatures on the DWC-24 form is the following language:
“Compliance Date __________. The agreement shall be fully complied with within five days of the approved agreement being received by the carrier, but, if the agreement includes a compliance date, that date will control.”
So, if the parties agreed to a compliance date in the space above, that date controls as your deadline to pay benefits. If they did not, then they have agreed to the five-day compliance deadline.
Please remember that any accrued benefits must be paid with interest in a lump sum, pursuant to Section 408.064 of the Act, and DWC Rules 126.12 and 134.130.
