Irving Chiropractor Eric Vanderwerff Barred from Providing WC Treatment

Feb 4, 2021 | by FOL

On December 21, 2020 Commissioner of Workers’ Compensation Cassie Brown signed an Emergency Cease and Desist Order that prohibits Eric A. Vanderwerff, D.C. from providing health care services in the Texas workers’ compensation system, including serving as a treating doctor, until he notifies DWC that the Texas Board of Chiropractic Examiners has allowed him to practice chiropractic medicine.

Dr. Vanderwerff’s license to practice chiropractic medicine allegedly expired October 1, 2020 and has not been renewed. The Commissioner’s order finds that between October 5, 2020, and November 12, 2020, Dr. Vanderwerff billed workers’ compensation insurance carriers $42,990.44 for health care services he provided to 14 injured employees while his chiropractic license was expired.

The Commissioner’s order took effect immediately and will continue in full force and effect until a further order is issued. The order is binding on Dr. Vanderwerff and subjects him to an administrative penalty of $25,000 per day per occurrence in the event the order is violated.

Carriers who paid Dr. Vanderwerff for services he performed after the expiration of his license may be entitled to reimbursement. If you believe you are so entitled, please contact Steve Tipton, James Sheffield or Bobby Stokes to discuss your reimbursement options.
