Workers’ Compensation Weekly Benefit Rates Set for October 1, 2020, Through September 30, 2021
The Division of Workers’ Compensation has announced it will raise the maximum level of weekly benefits by 3.7%. The workers’ compensation state average weekly wage for dates of injury from October 1, 2020, through September 30, 2021, is set at $1,006.71. The maximum weekly TIBs, LIBs and death benefits rates for workers’ compensation benefits are set at $1007 and the minimum weekly benefit rate is set at $151 for that period. The maximum weekly IIBs and SIBs rates for workers’ compensation income benefits are set at $705.
The maximum and minimum weekly TIBs, LIBs and death benefits rates for dates of injury from October 1, 2019, through September 30, 2020, were $971 and $146 respectively. The maximum weekly IIBs and SIBs rates for dates of injury from October 1, 2019, through September 30, 2020, were $679.
In accordance with Texas Labor Code §408.047, the workers’ compensation state average weekly wage is equal to 88 percent of the average weekly wage in covered employment as computed each year by the Texas Workforce Commission under TLC §207.002(c). The maximum level is set by law to an amount not to exceed 100 percent of the state’s average weekly wage.
